Exploding E-Cigarettes May Cause Injuries

There has been a dramatic increase in the use of e-cigarettes in the past few years. According to data provided by the Centers for Disease Control and Prevention (CDC), 12.6 percent of American adults report that they have tried e-cigarettes.

Currently, 3.7 percent of adults report that they use e-cigarettes more than once per week. This means that there are now 9 million adults vaping on a regular basis, this includes many people in Western North Carolina and Upstate South Carolina.

This should be good news, after all, e-cigarettes are supposed to be a safer alternative to smoking. However, recent events have raised very serious concerns about the safety of these devices.

Why Are E-Cigarettes Dangerous?

In March, CBS North Carolina reported that a Wilmington man lost his eye after his e-cigarette exploded. This is just one of many reports of e-cigarette explosions that have occurred around the country. Several news organizations including NBC News and Scientific American have covered this problem in detail.

The vast majority of vaping injuries appear to be related to the battery used in the product. Defective e-cigarette batteries have been reported to cause many very serious injuries, including severe burns, loss of eyesight and even broken bones.

There is an alarming lack of data related to the extent of this issue. However, it is clear that e-cigarette injuries are far from rare. In fact, NBC News reported that one hospital in Colorado had treated 6 different severe e-cigarette injuries within a two-month period.

Were You Injured By an E-Cigarette? You May Be Able to Take Legal Action

Victims of e-cigarette explosions deserve full and fair compensation for their injuries. The manufacturers and distributors of these products have a legal duty to ensure consumers are protected from unreasonable dangers.

Defective products should never be allowed on the market. In the event that a manufacturer or any other responsible party has failed to live up to their obligation to sell safe products, the injured victims may be entitled to bring a product liability claim against the company. Product liability claims generally come in one of the following forms:

  • Design defects – This type of defect occurs when an entire line of products is found to be unsafe. When injuries occur because of an inherent design flaw, legal action can be taken against the responsible company.
  • Manufacturing defects – If your individual unit was defective, you can bring a manufacturing defect claim. This claim is brought when an overall product design is acceptable, but your specific example of the product had a serious flaw that caused you harm.
  • Labelling defects – The type of claim can be brought against companies that fail to fairly warn consumers about the risks associated with a product.

Ultimately, if you have suffered any type of vaping injury, you need to take immediate legal action. You should contact an experienced product injury attorney who can comprehensively review your claim and determine your best path forward.
